The Philippine Supreme Court has made a landmark ruling that same-sex couples can be recognized as co-owners of property. This decision marks the first time the court has applied Article 148 of the Family Code to protect same-sex couples' property rights.
The case involved two women who had purchased a house together in suburban Manila. When they later disagreed about selling the property, one partner filed a legal claim to divide their assets. Lower courts initially rejected the claim, but the Supreme Court reversed this decision.
The court ruled that Article 148, which covers property relations for people who live together but cannot legally marry, applies to all couples regardless of gender. Justice Marvic Leonen stated that limiting this law would make some legitimate relationships "legally invisible." The court emphasized that both partners had contributed financially to acquiring the property, making them equal co-owners.
